Welfare Law

This course considers the evolution of the welfare state and the major legislative and significant case developments that have contributed to this area of law. Social Security law and the role of Legal Aid are considered. There is a focus upon a rights-based discourse, and gender, class, race, ethnicity and disability issues are canvassed in detail. The course also considers the evolving consumer legislation and case law, including a consideration of activist activity regarding consumer rights. There is a detailed discussion of alternative dispute resolution schemes in industry. Jurisdictional issues are discussed and the relevance of both Commonwealth and state based legislation.

Sociology of Law

Sociology is one of the modern social sciences which seeks to understand and explain the nature of complex social processes in small groups, communities and whole societies. Sociologists look at ideas, moral values, patterns of interaction and the persistence of institutions. The Sociology of Law takes as its particular focus the way conduct is defined as normal or deviant and the range of regulatory mechanisms to make and enforce this distinction. A sociological perspective on the law therefore is a singularly comprehensive issue here, as it is inclusive of the whole range of social relationships. From this perspective, both law as a mechanism of social regulation and law as a field of knowledge, become objects of study which can be explained in sociological terms.
